Domini Baldwin is a highly motivated and dynamic Chartered Quantity Surveyor, with over 15 years’ experience working for various contractors and consultants. She has been appointed as a quantum expert in UK litigation proceedings, as well having experience in deputy expert roles and advocacy commissions. Her experience includes dealing with contractual disputes comprising of, but not limited: to prolongation, delay, disruption, loss and expense during Mediation, Adjudication, Litigation and Arbitration, which have spanned over the UK, Europe, the Middle East and Oceania.

Expert Witness Support

Commercial/Residential

  • (Litigation) Quantum expert for a mixed-use development comprising of residential apartments and a commercial unit. Assessing cost changes pre planning and post planning.
  • (Pre-Litigation) One of the deputies on a London high rise development. Assessing losses in relation to direct costs, associated with alleged breaches, prolongation, thickening, professional fees and development costs.
  • (Pre-Adjudication) Deputy lead on a mixed-use development in Orpington, London. Assessing the main contractor’s prolongation, thickening, loss of overhead and interest claims.

Infrastructure

  • Expert Commission (International Arbitration). Deputy lead on a contractors loss of profit claim, as a result of an expropriation as a consequence of the civil war in Libya.
  • Expert Commission (Litigation). Deputy lead on multiple UK Highway repair disputes in litigation, assessing the remedial values in dispute.
  • Expert Commission (Litigation). Assistant on a dispute relating to a £200m claim, concerning a major London railway project in delay. Assessing the main contractor’s variations, prolongation, thickening, liquidated and ascertained damages, loss of overhead and interest claims.
  • Expert Commission (International Arbitration). Assistant on an international airport dispute in Oman. Duties included: analysis of claims, disruption, loss and expense resulting from the steelwork delays due to the transport vessel sinking offshore.

Healthcare

  • Expert Commission (Pre – Litigation). Deputy lead for defect rectification assessments on two major UK hospital carparks. The defects were in relation to resurfacing, drainage rectification and core finishes strip out/replacement. Including losses associated with relocation costs and damages under the asset management contract.
  • Expert Commission (Pre – Litigation). Deputy lead for defect rectification assessments for major UK hospitals in Pre Action stage, relating to building fabric and mechanical & electrical systems.

Education

  • Expert Commission (Pre – Litigation). Deputy lead for professional negligence claims against the cost consultant who undertook pre and post contract services on a large UK University campus.

Marine

  • Expert Commission (International Arbitration). Assistant on an international dispute concerning marine caisson installation from barges in Australia. Assessing the large variation account in dispute.

Commercial/Residential

  • Advocacy Role (Pre-Adjudication). Commercial Director managing a major UK Mechanical, Electrical and Plumbing (MEP) Contractor’s claim under a bespoke contract on a key carbon neutral commercial building in London, relating to vast amounts of variations resulting in prolongation and disruption.
  • Advocacy Role (Adjudication & Mediation). Lead Commercial Manager defending a £15million loss and expense claim, including extension of time provisions for a new build High-End residential development in Mayfair, London on a JCT MP 2011. This claim was subject to 13 Adjudications and 1 Mediation.
  • Advocacy Role (Adjudication). Associate Director, compiling and preparing all claim documents and running the adjudication proceedings for a MEP Subcontractor in relation to applications for payments and failure of the client to comply with the Housing Grants Construction Regeneration Act, UK, under a JCT D&B 2016 Subcontract.
  • Advocacy Role (Adjudication). Associate Director, compiling and preparing all claim documents and running the adjudication proceedings for a cladding Subcontractor in relation to applications for payments and failure of the client to comply with the Housing Grants Construction Regeneration Act, UK, under a JCT D&B 2016 Subcontract.

Healthcare

  • Advocacy Role (Pre-Adjudication). The Commercial Manager brought in to assist on a loss and expense claim, including extension of time provisions for inclement weather resulting in crane downtime at a large hospital development in Brighton UK, under an NEC option A contract.

Education

  • Advocacy Role (Adjudication/Mediation). The Commercial Director managing a Major UK Mechanical, Electrical and Plumbing Contractor’s claim on an arts college in London, relating to ground delays which resulted in critical projects delays and disruption under a JCT D&B 2016 Subcontract.

Marine

  • Advocacy Role (Adjudication). Associate Director, compiling and preparing all claim documents and running the adjudication proceedings in relation to a contract on the River Thames, London, in relation to design changes of the retaining structures causing loss, expense and prolongation under a bespoke marine contract.
